Upon payment, the Organizer shall acknowledge receipt of the order, by electronic means, without undue delay. The order, the offer confirmation and the acknowledgement of receipt shall be deemed to be received when the parties to whom they are addressed are able to access them.

GENERAL CONDITIONS OF SALE ARE GOVERNED BY FRENCH LAW

• The term «Organiser» or «CECJ» refers to the Centre Européen de Coopération Juridique (CECJ), a company incorporated under French law.
• The term «Participant» refers to a natural or legal person under French or foreign law who has subscribed, within the framework and for the needs of his/her professional activity, to a conference/training course offered by the Organiser for him/herself or in the name and on behalf of another person.
• The term «Speaker» refers to a professional who has been chosen by the Organiser to share his/her knowledge and experience on a given subject.
• The term «Event» refers to any conference, training or business event offered by the Organiser online or on site. The respective programme of each Event is detailed on the Website.
• The term «Site» refers to the Internet site accessible from the URL https://cecj.org/ link and any associated sub-sites, published by the Company to present and sell its various services.
• The term «User» refers to any person who uses the Site.
• The term «Agent» means any Organisation or person indicated by the Organiser as a representative to carry out certain actions and/or provide services to the Organiser. The Agent does not provide services to the Participants, Users, and acts solely in the interests of the Organiser.
• The term «General Terms and Conditions of Sale» refers to the terms and conditions applicable to the contractual relationship between the Company and its Clients, which include these Terms and Conditions and their annexes as well as any element of the Site to which they may refer.
• The term «Platform» means the Business Matching application made available to Participants by the Organiser for the period determined by the Organiser.

1. ARTICLE 1: SCOPE OF THE GTC
   1. Purpose. The purpose of these General Terms and Conditions is to govern the conditions of supply and purchase of services for Participants as well as the relationship between the Organiser and the Participant, including the terms of use of the https://cecj.org/ website and the training platforms published and provided by the Organiser, to the exclusion of any other document.
   2. Capacity. Any use of the Site and/or the Platform to benefit from the Trainings implies acceptance of, and compliance with, all the terms of these General Conditions. The Participant declares that he/she is of legal age and capable of entering into a contract under the law of his/her country and declares that he/she is not incapacitated or subject to any special protection provided for by the law of his/her country, in particular legal protection, guardianship or trusteeship, and declares that, where applicable, and in particular in the case of a protected adult, he/she has received all the authorisation required from the legal representative and is supervised for the use of the Site and/or validly represents the person on whose behalf he/she has entered into a contract.
   3. Access to the GTC. The General Terms and Conditions of Sale are accessible at any time on the Site and shall prevail, if necessary, over any other version. These General Terms and Conditions of Sale take effect from the date of their update indicated at the head of the present document.
      Acceptance of the GTC. The subscription, payment and validation of an «Event» proposed by the Organiser automatically entails acceptance and adherence without reservation to the general terms and conditions of sale.
   4. Exclusions from the provisions of the Consumer Code. The Participant expressly confirms that he/she is acting for purposes within the framework of his/her commercial, industrial or liberal activity, including when acting in the name of or on behalf of another professional, so that he/she has the status of «Professional» and thus the provisions of the Consumer Code do not apply to the relationship between him/her and the Organiser.
   5. The Organiser reserves the right to modify certain elements of this contract at any time, in accordance with the law. Changes to the GTC are binding on the users of the website. The version applicable to the Participant is the one in force on the Website at the time the Participant subscribes to an Event.
2. ARTICLE 2: ORDERING PROCESS
   1. Subscription to an Event. After having chosen the Event in which he/she is interested and having ensured that it corresponds to his/her expectations, the Participant, in order to place an order, is invited to enter his/her personal details (surname, first name, telephone number, e-mail address) and professional details (professional title, company, town of head office). Next, the Participant is invited to enter his/her billing details (exact postal address of his/her company). Finally, the Participant must choose a payment method (payment by credit card or bank transfer) and agree to the general terms and conditions of sale and the privacy policy.
   2. Verification of the order before validation. The Participant checks the summary information of his order before validating it and moving on to the payment phase by the double-click method. The first click allows the order to be validated and the second click allows the order to be definitively confirmed after having checked and, if necessary, corrected it.
   3. Confirmation of the order. After placing his/her order, the Participant will receive an e-mail confirmation providing the information relating to the order as well as a link to the general terms and conditions and the confidentiality policy applicable to his/her order, which he/she may print or save for archiving purposes. Once confirmed and accepted by the Company, under the conditions described above, the order cannot be cancelled, except in the event of the exercise of the right of withdrawal, force majeure, the exercise of a commercial guarantee or any other case provided for by these General Conditions, the law or an enforceable court decision.
3. ARTICLE 3: PRICING CONDITIONS
   1. Prices for Services. The prices applicable to the Organiser’s Events are those in force on the Site on the day the Participant’s order is registered or in force on the quote issued. They are indicated exclusive of tax and inclusive of VAT.
   2. Special offers and discount vouchers. The Organiser reserves the right to propose introductory offers of limited duration, promotional offers or price reductions on its Events and to revise its offers and prices on the Site at any time, under the conditions provided for by law. The applicable rates are those in force at the time of the Participant’s order, and the Participant may not take advantage of other rates prior or subsequent to his/her order. The discount vouchers may be subject to special conditions and are in any event strictly personal to their beneficiary and may be used only once.
4. ARTICLE 4: PAYMENT
   1. Payment by the Participant signifies acceptance of these terms and conditions.
   2. Method of payment. Payment can be made either by credit card or by bank transfer to the Organiser’s bank account or to the bank account of Organiser’s Partner abroad.
      1. Payment by bank card. The Participant may pay for the Event online by bank card, i.e., by direct debit using the payment systems and services offered, which are secure services provided by third parties of the Organiser. By providing his/her bank and billing details, the Participant guarantees that he/she is of legal age and that he/she is the legal holder of the card to be debited and that he/she is legally entitled to use it. In the event of an error or the impossibility of debiting the card, the sale shall be immediately cancelled by operation of law and the order for the Course shall be cancelled. The direct debit is carried out by the payment service provider «SOGECOMMERCE, a subsidiary of La Société Générale», a third party to the Organiser, subject to its own contractual conditions over which the Company has no control (https://sogecommerce.societegenerale.eu/doc/fr-FR/back-office/dashboard/se-connecter-au-back-office-marchand.html). Payment for the Events is made as soon as the Organiser, after receiving an order confirmation, has accepted it and the direct debit has been made. Any Event not paid in full cannot be delivered. In this case, payment is made by direct debit using the credit card information provided (card number, expiry date, security number, name of the cardholder), according to the payment method offered by the payment service provider and the choice of the Participant. Payment requires that the Participant has a valid sending and receiving e-mail box. To this end, the Participant’s e-mail address will be requested before the bank debit. If the Participant does not have a valid e-mail address, he/she will not receive written confirmation of his/her order, including a copy of these GTC. The Organiser reserves the right to use the payment service providers of its choice and to change them at any time. By confirming the order, the Participant authorises the debiting of the amount indicated
      2. Payment by bank transfer. In the case of payment by bank transfer, a quotation will be issued, the validation of which is fixed. In the event of non-payment within the indicated period, the quotation shall automatically lapse. In order to receive a new quote, a new request must be made. Payment by bank transfer involves additional bank charges to be paid by the Participant.
   3. The Organiser has the right to unilaterally refuse at his/her discretion the participation of any Participant in the Event at any time during the preparation of the Event, without being obliged to provide a reason with a refund within 180 days minus bank transfer charges.
   4. Payment is made to the Organiser’s account and, on receipt, a paid invoice is issued to the exclusion of any other document.
   5. If the invoice is issued to several Participants at the same time, and/or if the order and/or payment was made by a third party, the Participant agrees with these General Conditions and the third party is obliged to send the General Conditions to the Participant.
   6. Once the subscription has been validated by the Participant, no retraction is possible and all choices are final.
   7. Payment incident — Fraud. The Organiser may need to contact the Participant to request additional documents in order to execute the payment of the order. The Organiser may rely on the information provided by the order analysis system. The provision of the requested documents is necessary for the Company to issue the order. In order to combat credit card fraud, a visual check of the means of payment may be carried out by the Company’s customer service department before making the Course available. In the event of fraudulent use of the Participant’s bank card, the Organiser is invited to contact us as soon as it is discovered that the card has been used, without prejudice to the steps to be taken by the Participant with his bank.
5. ARTICLE 5: ACCESS TO SERVICES
   1. Access to the Site. The Site is accessible free of charge to any person with Internet access. All costs relating to access to the Site, whether hardware, software or Internet access costs, are exclusively borne by the Users. The Organiser cannot be held responsible for any material damage related to the use of the Site. Furthermore, the user of the Site undertakes to access the Site using recent equipment, free of viruses and with the latest generation updated browser. The User is solely responsible for the proper functioning of his computer equipment and his access to the Internet.
   2. Access to the Business Matching App Platform.
      1. If, for any reason beyond the control of the Organiser, the Application could not be used during the Event, the Organiser undertakes to find an alternative way of providing the algorithms present in the Application via a different technical format.
      2. The Organiser shall not be held responsible for the results of the matchmaking between the Participants on the Platform, which are exclusively dependent on the intrinsic and respective professional and personal characteristics of each Participant.
      3. The Organiser cannot be held responsible for the accuracy of the personal and professional information of the Participants indicated on the Platform.
      4. The Organiser may not disclose the algorithms making up the Application.
      5. The Platform is made available to Participants for a fixed period of time determined by the Organiser and communicated in advance, which period may be set at the end of the Event. As soon as the Organiser has communicated this end date of the Service, Participants undertake to take all useful conservation measures in order to keep a copy of any data hosted on the Platform, and the Organiser may not be held liable for any loss of data in this respect.
      6. Maintenance and updates. The Site and the Platform may be subject to maintenance operations. To this end, the Organiser reserves the right to interrupt, temporarily suspend or modify, without prior notice, access to all or part of the Site or the Platform, in order to carry out maintenance (in particular by means of updates), or for any other reason, without the interruption giving rise to any obligation, compensation or reimbursement.
      7. Any changes to the terms and conditions of use of the Platform will be communicated to the Participant electronically.
6. ARTICLE 6: ORGANISATION OF EVENTS
   1. The costs of accommodation, flights, meals, transfers, medical insurance and/or any other expenses of the Participant are not covered by the Organiser and are not included in any of the prices. Consequently, the Participant must pay them directly and on his own behalf.
   2. Cases of force majeure or fortuitous events which may lead to changes in the programme or cancellation by the Organiser. The following are considered to be cases of force majeure or fortuitous events, in addition to those usually recognised by the jurisprudence of the courts and tribunals, without this list being restrictive: health crises, epidemics, pandemics, strikes or social conflicts internal or external to the Organiser’s company, natural disasters, fires, interruption of telecommunications, interruption of energy supply, interruption of communications or transport of any kind, civil or military wars, or any other circumstance beyond the Company’s reasonable control. These cases of force majeure may occur in the country of departure of the Participant, in the countries of transit, if any, and in the country of destination where the conference/training is held.
   3. Administrative formalities. The Participant is personally responsible for all documents that he/she may need to obtain in advance according to his/her country of origin, provenance and destination, as well as for all tests and medical certificates that may be required by the public authorities.
   4. Modification or cancellation of the Event. In the event of a change of dates or cancellation of the Event, the Participant will bear all financial risks associated with the Event.
   5. Communications between the Participant and the Organiser.
      1. Exchanges of information between the parties in relation to the Event will in principle take place by means of e-mail exchanges according to the e-mail address that will have been provided when the profile was created and the Event was paid for, or by messages via a messaging service determined between them.
      2. All exchanges between the Participant and the Organiser prior to the start of the course will be in English.
      3. Participants are forbidden to use defamatory, threatening, hateful, intolerant, obscene, etc. speech and any disparaging speech or publication that may infringe the rights of the Organiser, another Participant or third parties and is contrary to the law. The Organiser reserves the right to remove the author of the comments made from the training room and to take any legal action he/she deems appropriate.
      4. If a Participant breaks, shatters or damages an object on the premises where the Event takes place, the costs of material damage caused to third parties will be borne by the Participant.
   6. Special terms and conditions applicable to PREMIUM category Participants.
      1. The Gala Dinner.
         1. Exclusive invitation. The invitation to the Gala Dinner is a gift exclusively dedicated to Participants who have subscribed to the «PREMIUM» package and therefore belong to this category.
         2. Imposed menu. Consequently, the menu and drinks are imposed by the Organiser, and with the exception of possible allergens or food prohibitions which must be indicated to the Organiser no later than 7 days before the Event, the Participants cannot refuse the imposed meal and demand another menu.
         3. Mandatory dress code. At the Gala Dinner there is a compulsory dress code called Black-Tie. This code can be defined as an evening dress (less formal than white tie) consisting of a tuxedo jacket, matching trousers, a white shirt and a black bow tie, or a national costume or military dress. If this is not respected, entry will not be allowed.
         4. Accompanying Persons. Accompanying Persons may not be present at training conferences, or receptions organised as part of the Event or Gala dinners.
   7. Map of the geographical location of the Event. The Event is held in a geographical area which will be divided into two zones, respectively named «Business Zone» and «Premium Zone». The plan of the zones may be modified at any time by the Organiser.
   8. No permission for Participants to make a filmed recording of the Event. The Organiser can record the training sessions that will be given for archiving purposes but these recordings will not, in principle, be transmitted to the Participant. It is therefore up to the Participant to take all useful notes during the oral explanations provided by the speakers at the Event if a physical or digital medium is not transmitted by the speaker. It is strictly forbidden for the Participant to record the training provided during the Event.
7. ARTICLE 7: LIABILITY
   1. The Organiser is not responsible for:
      1. any unsatisfied subjective expectations of the Participant relating to the organisation and running of the Event and which have not been expressly provided for in these general conditions;
      2. the life, health and personal effects of the Participant during the Event, nor accidents or thefts of goods committed against the Participant or third parties;
      3. the Participant’s personal expenses related to transport, catering, hotel reservations, tickets, accommodation in the city where the event takes place, health insurance and other expenses of the Participant either during the Event or in the event of modification or cancellation due to force majeure;
      4. the behaviour, statements or personal opinion of any of the Participants in the Event;
      5. any technical malfunction of the network or servers or any other event beyond reasonable control which would result in the cancellation or modification of any part of the programme;
      6. decisions by the competent bodies on whether or not to include training hours as «vocational training hours»;
      7. information that the Participant personally provides;
      8. actions, omissions, by any third party directly or indirectly or in any capacity whatsoever involved in the organisation of the Event and which lead to malfunctions in the work, the running, the change of the programme and in general to any modification in the organisation, the running or otherwise in relation to the description of the programme and/or the running of the Event;
      9. the future collaboration with the specialists who participate or for the teachings given by them during the Event;
      10. the plan/structure of the intervention, the sources of information as well as the possible supports (distribution, form, volume or other) determined by the Interveners;
      11. For images, photos and/or video made by the Participants to the Event and their subsequent use and/or summary/quotation of the teaching given at the Event on social networks or another platform;
      12. the quality of the Participant’s image in the photos and videos taken during the Event, and/or which will be transmitted to the Participants after the Event;
      13. In any event, the Organiser’s liability towards the Participant, a professional, is limited to the amount of the price paid by him/her, exclusive of tax, in return for the provision of the service in the context of which the dispute arises. This amount is understood to be the maximum amount that the Organiser could be required to pay as compensation (damages and interest) and as a penalty, whatever the damage alleged and the legal grounds adopted.
8. ARTICLE 8: CONDITIONS OF CANCELLATION AND/OR CHANGE OF DATES
   1. Regardless of the nature or seriousness of the reason for cancellation of the registration, the cancellation procedure is the same.
   2. Force majeure. In case of force majeure, the Organiser has the right to make necessary changes to the programme, to postpone the Event to new dates or to cancel the programme.
   3. Partial or total modification of the terms and conditions of the Event (change of place, date) does not entitle the Participant to any compensation.
   4. Regardless of the circumstances that may cause the cancellation of all or part of an announced intervention, the Organiser reserves the right to organise or not to organise this intervention at a later date or to organise it in an online format or without providing a report.
   5. In the event of cancellation of the Event by the Organiser. If the Organiser cancels the Event, it will refund the Participant the full amount of the price paid regardless of category within 180 days of receipt of the Refund Form completed by the Participant.
   6. If the Event is modified by the Organiser.
      1. If the Organiser makes changes to the programme dates, the period between the Organiser’s announcement of the postponement and the announcement of the new programme dates may be up to 2 years, depending on the seriousness of the situation constituting the force majeure which necessitated the postponement.
      2. Only after the announcement of new dates, if they are not convenient for the Participant, the Participant has the possibility of requesting a refund which will be made within 180 days following the receipt of the Refund Form filled in by the Participant.
      3. In the event of a refund, it will be made to the Participant’s bank card, if the payment was made by bank card (if the time limit for refunding by bank card has not been exceeded) or by transfer to the current account in euros, according to the details indicated by the Participant in the completed form.
      4. The amount of the refund may be unilaterally reduced by the Organiser by the amount of the bank commission due to the international transfer.
   7. The Organiser is not responsible for the financial risk incurred by the Participant in the event of a change of programme dates or cancellation of the programme.
   8. In the event that the Participant can no longer attend the Event regardless of the reason:
      1. STANDARD : If the Participant is no longer able to attend the Event for which he/she has registered, and in the event that no change in the organisation of the Event has been imposed by the Organiser, the STANDARD FARE is not refundable and is not exchangeable.
      2. BUSINESS and PREMIUM rates: In the event that the Participant can no longer take part in the Event, even though no change in the organisation of the Event has been imposed by the Organiser, these rates give the possibility for reimbursement without penalty if the cancellation has been made before the date indicated in the table summarising the services by category and their respective registration fees. After this date, and before the event takes place, the reservation price paid by the Participant will no longer be refundable. This is expressly stated in the summary table and the Participant expressly agrees to this.
9. ARTICLE 9: RIGHT TO IMAGE
   Image rights. During the Event, the Participant expressly authorises the Organiser to take photographs or films of the Participant and to re-use these images for advertising or commercial purposes. The Participant waives any remuneration for the use by the Organiser of these media for advertising or commercial purposes.
10. ARTICLE 10: INTELLECTUAL PROPERTY
    1. The Organiser is the owner of all intellectual property rights relating to the Website and the Platform, content, texts, images, graphics, logos, icons, sounds, software constituting the tools and training materials for the Events, and the Platform which belong to it or holds the rights of use relating thereto, except for the materials created by a Participant, the latter retaining all intellectual property rights on its creations.
    2. Access to the Site and/or the Platform does not confer any right on the User to the intellectual property rights relating to the Sites and the Platform, which remain the exclusive property of the Organiser or the third-party trainers.
    3. The User may not, under any circumstances, reproduce, represent, modify, transmit, publish, adapt, on any medium whatsoever, by any means whatsoever, or exploit in any way whatsoever, all or part of the Sites or Platform without the prior written authorisation of the Organiser or the third-party trainers. Any exploitation not previously authorised by the Organiser or third parties, in any capacity whatsoever, of all or part of the Sites and Platform may be the subject of any appropriate action, including an action for infringement.
    4. In return for payment of the price requested at the time of the order, the content, techniques, know-how, methods provided and transmitted and more generally all information and access to the Platform or to any type of content that may form part of the Service provided are subject to a personal, non-transferable and non-exclusive right of use for the duration of the Service. In this respect, the Participant shall refrain from using and exploiting the Service on behalf of other persons. The Participant shall be liable in the event of unauthorised transfer or communication of the content or access codes.
    5. The Participant is responsible for the respect of the intellectual property rights of the Organiser or the Participants by all of its employees who may have authorised access to the contents of the Site, Service and/or Platform or who may be Users.
    6. All distinctive signs by the Organiser are protected by law and any unauthorised use by the Company may result in prosecution.
    7. Failure to comply with this clause will be considered as a serious fault on the part of the Participant, which will be detrimental to the Organiser, who reserves the right, in this case, to terminate the contract at the Participant’s expense.
11. ARTICLE 11: PROTECTION OF PERSONAL DATA
    1. The Organiser respects the privacy of the Participants and undertakes to ensure that the collection and automated processing of their data for the purposes of commercial prospecting, order management and delivery of the Service, carried out from the Sites and any platforms, comply with the General Data Protection Regulation n°2016-679 of 27 April 2016 known as the «RGPD», with the ePrivacy Directive, as well as with Law n° 78-17 of 6 January 1978 as amended, known as the «Data Protection Act».
    2. For more information on the automated processing of data and the methods of exercising their rights, all Users may consult the confidentiality policy accessible at any time on the Site via the URL XXX link and the information on the cookies used by the Company for more information.
    3. The Participant is informed and accepts that the Service may include technical devices allowing the use of the Service to be monitored (account of the connected user, IP address, type of application used, various connection and usage logs, viewing and downloading data) which may be used in the context of the fight against counterfeiting, and/or to identify and/or prevent any illicit or non-compliant performance of the Service.
    4. The Participant also has the right to lodge a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL), notably on its website www.cnil.fr.
12. ARTICLE 12: INVALIDITY OR MODIFICATION OF ONE OR MORE CLAUSES OF THE CONTRACT
    If any provision of this Agreement is invalidated, such invalidity shall not invalidate the remaining provisions of the Agreement, which shall remain in force between the parties. Any amendment, termination or waiver of any of the provisions of this contract shall only be valid after written and signed agreement between the parties.
13. ARTICLE 13: PARTNER SITES — HYPERTEXT LINKS
    The User may access, via the hypertext links present on the Site or the Platform, the sites of Partners or third parties, which are not governed by these General Conditions. The User is therefore invited to examine the general conditions of use or sale, as well as the privacy policies or any other legal information, applicable to these sites. The Participant is informed that the Service may require access to other sites or platforms, designed and managed under the responsibility of third parties. The Company has no control over the content of these sites and declines all responsibility for their content and the use made by any third party of the information contained therein. This clause applies to all content of the Partners.
14. ARTICLE 14: DISPUTES/DISPUTES
    1. Applicable law. These GTC are governed by French law, subject to the provisions that may apply depending on the nationality or domicile of the Participant.
    2. Languages. These GTC are written in French and English. In the event of disputes, the French text shall prevail.
    3. In the event of a breach of this contract by the Participant, the Organiser is entitled to:
       1. Issue a warning to the Participant;
       2. To suspend any further participation of the Participant in the event;
       3. To prohibit the Participant from participating in any future events of the Organiser;
       4. To contact the competent authorities both in the country of the Event and in the country of nationality/residence of the Participant;
       5. To apply to the court in the place where the Organiser has its headquarters.
    4. Amicable resolution of the dispute between the parties. Any dispute between the parties concerning the scope, existence, validity, interpretation and application of these GTCs shall be resolved amicably. To this end, the Participant must address his complaints to the Organiser by post with AR. The Organiser is obliged to examine the complaints received and to provide a response within 30 working days of the date of receipt.
    5. If an amicable resolution of the dispute between the parties is not possible, the Organiser’s lawyers will automatically substitute themselves for the Organiser in order to take charge of all correspondence and communication in French with the Participant at the Organiser’s headquarters.
    6. All legal and judicial costs relating to the amicable settlement (negotiations by lawyers) or judicial proceedings (legal action taken by the Organiser or the Participant) shall be borne exclusively by the Participant.
    7. In the event of a legal dispute, the courts of the city of the Organiser’s registered office will have exclusive jurisdiction.

• Le terme «Organisateur» ou «CECJ» désigne la société Centre Européen de coopération juridique (CECJ), société de droit français.
• Le terme « Participant » désigne une personne physique ou morale de droit français ou étranger qui a souscrit dans le cadre et pour les besoins de son activité professionnelle à une conférence/formation proposée par l’Organisateur pour elle-même ou au nom et pour le compte d’une autre personne.
• Le terme « Intervenant » désigne un professionnel qui pour son expérience a été choisi par l’Organisateur afin de partager ses connaissances et son expérience sur un thème donné.
• Le terme « Evènement » désigne toute conférence, formation ou évènement d’affaires proposés par l’Organisateur en ligne ou sur place. Le programme respectif de chaque Evènement est détaillé sur le Site.
• Le terme « Site » désigne le site internet accessible à partir du lien URL https://cecj.org/ et tous les sous-sites éventuellement associés, édités par la Société pour présenter et vendre ses différents services.
• Le terme « Utilisateur » désigne toute personne qui utilise le Site.
• Le terme «Agent» désigne toute organisation ou personne indiquée par l’Organisateur en tant que représentant pour mener à bien certaines actions et/ou fournir des services à l’Organisateur. L’Agent ne fournit pas de services aux Participants, Utilisateurs, et agit uniquement dans l’intérêt de l’Organisateur.
• Le terme « Conditions Générales de Vente ; CGV » désigne les conditions applicables à la relation contractuelle entre la Société et ses Clients qui comprennent les présentes et ses annexes ainsi que tout élément du Site auquel elles peuvent renvoyer.
• Le terme « Plateforme » désigne l’application Business Matching mis à disposition des Participants par l’Organisateur pour la durée déterminée par l’Organisateur.

1. ARTICLE 1 : CHAMPS D’APPLICATION DES CGV
   1. Objet. Les présentes Conditions Générales ont pour objet de régir les conditions de fourniture et d’achat des prestations de services à destination des Participants ainsi que les relations entre l’Organisateur et le Participant, ce qui inclut les modalités d’utilisation du Site https://cecj.org/ et des plateformes de formation édités et fournis par l’Organisateur, et ce, à l’exclusion de tout autre document.
   2. Capacité. Toute utilisation du Site et/ou de la Plateforme pour bénéficier des Formations supposent l’acceptation et le respect de l’ensemble des termes des présentes Conditions Générales. Le Participant déclare être majeur et capable de contracter en vertu de la loi de son pays et déclare ne pas être en situation d’incapacité ou faire l’objet d’une protection particulière prévue par la loi de son pays, notamment procédure de sauvegarde de justice, tutelle ou curatelle et déclare, le cas échéant et notamment en cas de majeur protégé, avoir reçu toute autorisation du représentant légal nécessaire et être supervisé pour l’utilisation du Site et/ou valablement représenter la personne pour laquelle il s’engage.
   3. Accès aux CGV. Les Conditions Générales de Vente sont accessibles à tout moment sur le Site et prévaudront, le cas échéant, sur toute autre version. Ces Conditions Générales de Vente prennent effet à compter de leur date de mise à jour indiquée en-tête des présentes.
   4. Acceptation des CGV. La souscription, le paiement et la validation d’un « Evènement » proposée par l’Organisateur emporte de plein droit l’acceptation et l’adhésion sans réserve aux conditions générales de vente.
   5. Exclusions des dispositions du Code de la consommation. Le Participant confirme expressément agir à des fins entrant dans le cadre de son activité commerciale, industrielle, ou libérale, y compris lorsqu’il agit au nom ou pour le compte d’un autre professionnel, de telle sorte qu’il revêt la qualité de « Professionnel » et ainsi les dispositions du Code de la consommation ne s’appliquent pas aux relations entre celui-ci et l’Organisateur.
   6. L’Organisateur se réserve le droit de modifier certains éléments de ce contrat à tout moment, dans les conditions prévues par la loi. Les modifications des CGV sont opposables aux utilisateurs du site internet. La version applicable au Participant est celle en vigueur sur le Site internet au moment où celui-ci souscrit à un Evènement.
2. ARTICLE 2 : PROCESSUS DE COMMANDE
   1. Souscription à un Evènement. Après avoir choisi l’Evènement qui l’intéressait et s’être assuré que ce dernier correspondait à ses attentes, le Participant, pour passer commander, est invité à entrer ses coordonnées personnelles (nom, prénom, numéro de téléphone, adresse électronique) et professionnelles (titre professionnel, entreprise, ville du siège social). Ensuite, le Participant est invité à entrer ses coordonnées de facturation (adresse postale exacte de sa société). Enfin, le Participant doit opter pour une méthode de paiement (paiement par carte bancaire ou virement bancaire) et agréé aux conditions générales de vente ainsi qu’à la politique de confidentialité.
   2. Vérification de la commande avant validation. Le Participant vérifie les informations récapitulatives de sa commande avant de la valider et de passer à la phase de paiement par la méthode du double clic. Le premier clic permet de valider la commande et le second clic permet de confirmer définitivement la commande après l’avoir vérifié et, au besoin, corrigée.
   3. Confirmation de la commande. Après passation de sa commande, le Participant reçoit par mail une confirmation fournissant les informations relatives à la commande ainsi qu’un lien de renvoi vers les conditions générales et la politique de confidentialité applicables à sa commande qu’il pourra imprimer ou enregistrer à des fins d’archivage. Une fois confirmée et acceptée par la Société, dans les conditions ci-dessus décrites, la commande ne peut être annulée, hors l’exercice du droit de rétractation, cas de force majeure, exercice d’une garantie commerciale ou tout autre cas prévu par les présentes Conditions Générales, la loi, ou une décision judiciaire exécutoire.
3. ARTICLE 3 : CONDITIONS TARIFAIRES
   1. Tarifs des Services. Les prix applicables aux Evènements de l’Organisateur sont ceux en vigueur sur le Site au jour de l’enregistrement de la commande du Participant ou en vigueur sur le devis émis. Ils sont indiqués HT et TTC.
   2. Offres spéciales et bons de réduction. L’Organisateur se réserve la possibilité de proposer des offres de lancement limitées dans le temps, des offres promotionnelles ou réductions de prix sur ses Evènements et de réviser ses offres et tarifs sur le Site à tout moment, dans les conditions prévues par la loi. Les tarifs applicables sont ceux en vigueur au moment de la commande du Participant, et le Participant ne peut se prévaloir d’autres tarifs antérieurs ou postérieurs à sa commande. Les bons de réduction peuvent être soumis à des conditions particulières, et sont en tout état de cause strictement personnels à leur bénéficiaire et utilisable une fois.
4. ARTICLE 4 : PAIEMENT
   1. Le paiement effectué par le Participant signifie l’acceptation des présentes conditions générales.
   2. Mode de paiement. Le Paiement peut être fait soit par paiement par carte bancaire, soit par virement bancaire au compte bancaire de l’Organisateur ou au compte bancaire de son partenaire à l’étranger.
      1. Paiement par carte bancaire. Le Participant peut régler l’Evènement en ligne par carte bancaire, c’est-à-dire par prélèvement bancaire avec les systèmes et services de paiement proposés, qui sont des services sécurisés fournis par des tiers de l’Organisateur. En renseignant ses coordonnées bancaires et ses coordonnées de facturation, le Participant garantit qu’il est majeur capable et qu’il est bien le titulaire légal de la carte à débiter et qu’il est légalement en droit d’en faire usage. En cas d’erreur ou d’impossibilité de débiter la carte, la vente est immédiatement résolue de plein droit et la commande de la Formation annulée. Le prélèvement bancaire s’effectue par le prestataire de service de paiement « SOGECOMMERCE, une filiale de La Société Générale » tiers à l’Organisateur, soumis à des conditions contractuelles propres sur lesquelles la Société n’exerce aucun contrôle (https://sogecommerce.societegenerale.eu/doc/fr-FR/back-office/dashboard/se-connecter-au-back-office-marchand.html). Le paiement des Evènements a lieu dès que l’Organisateur, après avoir reçu une confirmation de commande, l’a accepté et que le prélèvement bancaire est intervenu. Tout Evènement non payé dans son intégralité ne pourra être délivré. Dans ce cas, le paiement s’effectue par prélèvement à partir des informations de carte bancaire communiquées (numéros de la carte, date d’expiration, numéro de sécurité, nom du porteur de la carte), selon le mode de paiement proposé par le prestataire de service de paiement et le choix du Participant. Le paiement nécessite que le Participant dispose d’une boîte aux lettres électronique d’envoi et de réception valable. A cette fin, l’adresse électronique du Participant sera demandée avant le prélèvement bancaire. A défaut, il ne pourra recevoir de confirmation écrite de sa commande, avec une copie des présentes CGV. L’Organisateur se réserve la possibilité de faire appel aux prestataires de service de paiement de son choix et d’en modifier à tout moment. En confirmant la commande, le Participant autorise le débit du montant indiqué.
      2. Paiement par virement bancaire. Dans le cas d’un paiement par virement bancaire, un devis sera émis. En cas de non-paiement dans ce délai indiqué, le devis devient caduc de plein droit. Pour recevoir un nouveau devis, une nouvelle demande doit être formée. Le paiement par virement bancaire implique des frais bancaires supplémentaires à la charge du Participant.
   3. L’Organisateur a le droit de refuser unilatéralement et à sa discrétion la participation de tout Participant à l’Evènement à tout moment de la préparation de l’Evènement, sans être tenu d’en fournir la raison avec un remboursement dans les 180 jours moins les frais de virement bancaire.
   4. Le paiement est fait sur le compte de l’Organisateur et donne lieu à sa réception, à l’établissement d’une facture acquittée à l’exclusion de tout autre document.
   5. Si la facture est émise à plusieurs Participants en même temps, et/ou si la commande et/ou le paiement a été fait par un tiers, le Participant agrée avec les présentes Conditions Générales et le tiers s’oblige à faire parvenir les Conditions Générales au Participant.
   6. Une fois la souscription validée par le Participant aucune rétractation n’est possible et tout choix est définitif.
   7. Incident de paiement — Fraude. L’Organisateur pourra être amenée à contacter le Participant pour demander des pièces complémentaires pour exécuter le paiement de la commande. L’Organisateur peut s’appuyer sur les informations délivrées par le système d’analyse des commandes. La fourniture des pièces demandées est nécessaire à la délivrance de la commande par la Société. Afin de lutter contre la fraude à la carte bleue, une vérification visuelle des moyens de paiement peut être réalisée par le service client de la Société avant de rendre accessible la Formation. En cas d’utilisation frauduleuse de sa carte bancaire, l’Organisateur est invité, dès le constat de cette utilisation, à nous contacter, et ce sans préjudice des démarches devant être réalisées par le Participant auprès de sa banque.
5. ARTICLE 5 : ACCES AUX SERVICES
   1. Accès au Site. Le Site est accessible gratuitement à toute personne disposant d’un accès à internet. Tous les coûts afférents à l’accès au Site, que ce soit les frais matériels, logiciels ou d’accès à Internet sont exclusivement à la charge des Utilisateurs. L’Organisateur ne pourra être tenu responsable de dommages matériels liés à l’utilisation du Site. De plus, l’utilisateur du Site s’engage à accéder au Site en utilisant un matériel récent, ne contenant pas de virus et avec un navigateur de dernière génération mise à jour. L’Utilisateur est seul responsable du bon fonctionnement de son équipement informatique ainsi que de son accès à internet.
   2. Accès à la Plateforme Business Matching App.
      1. Si, pour une raison indépendante de la volonté de l’Organisateur, l’Application ne pouvait être utilisée durant l’Evènement, l’Organisateur s’engage à trouver une alternative afin de fournir les algorithmes présents dans l’Application via un format technique différent.
      2. L’Organisateur ne pourra être tenu responsable des résultats de mise en relation entre les Participants sur la Plateforme qui sont exclusivement fonction des caractéristiques professionnelles et personnelles intrinsèques et respectives de chaque Participant.
      3. L’Organisateur ne pourra être tenu responsable de la véracité des informations personnelles et professionnelles des Participants indiquées sur la Plateforme.
      4. L’Organisateur ne peut divulguer les algorithmes constituant l’Application.
      5. La Plateforme est mise à la disposition des Participants pour une durée déterminée fixée par l’Organisateur et communiquée préalablement, cette durée pouvant être fixée à la fin de l’Evènement. Dès la communication par l’Organisateur de cette date de fin du Service, les Participants s’engagent à prendre toute mesure utile de conservation afin de conserver une copie des éventuelles données hébergées sur la Plateforme, et l’Organisateur ne pourra pas être tenu responsable pour les éventuelles pertes de données à ce titre.
      6. Maintenance et mises à jour. Le Site et la Plateforme peuvent faire l’objet d’opérations de maintenance. A cette fin, l’Organisateur se réserve la possibilité d’interrompre, de suspendre momentanément ou de modifier sans préavis, l’accès à tout ou partie du Site ou de la Plateforme, afin d’en assurer la maintenance (notamment par le biais de mises à jour), ou pour toute autre raison, sans que l’interruption n’ouvre droit à aucune obligation ni indemnisation, ni remboursement.
      7. Toute modification des conditions d’utilisation de la Plateforme sera communiquée au Participant par voie électronique.
6. ARTICLE 6 : MODALITES D’ORGANISATION DES EVENEMENTS
   1. Les frais d’hébergement, des vols, des repas, des transferts, de l’assurance médicale et/ou toute autre dépense du Participant ne sont pas pris en charge par l’Organisateur et ne sont compris dans aucun des tarifs. En conséquence, le Participant doit les payer directement et personnellement.
   2. Cas de force majeure ou fortuits qui peuvent entraîner des modifications du programme ou une annulation par l’Organisateur. Sont considérés comme des cas de force majeure ou cas fortuit, outre ceux habituellement reconnus par la jurisprudence des cours et tribunaux sans que cette liste ne soit restrictive : crises sanitaires, épidémies, pandémies, grèves ou conflits sociaux internes ou externes à la société de l’Organisateur, les désastres naturels, les incendies, l’interruption des télécommunications, l’interruption de l’approvisionnement en énergie, l’interruption des communications ou des transports de tout type, guerres civiles ou militaires, ou tout autre circonstance échappant au contrôle raisonnable de la Société. Ces cas de force majeure peuvent survenir aussi bien dans le pays de départ du Participant, les pays de transit éventuels et dans le pays de destination où se tient la conférence/formation.
   3. Formalités administratives. Le Participant est responsable personnellement de tous les documents qu’il lui serait nécessaire d’obtenir préalablement en fonction de son pays d’origine, de provenance et du pays de destination ainsi que de tous les tests et certificats médicaux qui seraient exigés par les autorités publiques.
   4. Modification ou annulation de l’Evènement. En cas de changement des dates ou de l’annulation de l’Evènement, le Participant supportera tous les risques financiers affiliés.
   5. Communications entre le Participant et l’Organisateur.
      1. Les échanges d’informations entre les parties relativement à l’Evènement se feront par principe, par échanges de courriels selon adresse mail qui aura été renseignée lors de la création du profil et du paiement de l’Evènement ou de messages via un service de messagerie déterminé entre eux.
      2. Tous les échanges entre le Participant et l’Organisateur avant le début de la formation s’effectueront en langue anglaise.
      3. Il est interdit aux Participants de tenir un discours diffamatoire, menaçant, haineux, intolérant, obscène, etc. et de tout propos ou publication dénigrant de nature à porter atteinte aux droits de l’Organisateur, d’un autre Participant ou des tiers et contraire à la loi. L’Organisateur se réserve le droit de renvoyer l’auteur des propos tenus de la salle de formation et d’engager toute poursuite judiciaire qu’il estimera utile.
      4. Si un Participant casse, brise ou endommage un objet dans les locaux où se déroule l’Evénement, les coûts des dommages matériels causés aux tiers seront supportés par le participant.
   6. Modalités particulières applicables aux Participants de la catégorie PREMIUM.
      1. Le Dîner de Gala.
         1. Invitation exclusive. L’invitation au dîner de Gala constituent un cadeau exclusivement dédié aux Participants ayant souscrit la formule « PREMIUM » et appartenant donc à cette catégorie.
         2. Menu imposé. Par conséquent, le menu et les boissons sont imposés par l’Organisateur, et à l’exception des éventuelles allergènes ou interdictions alimentaires qu’il conviendra d’indiquer au plus tard 7 jours avant l’Évènement, les Participants ne peuvent refuser le repas imposé et exiger un autre menu.
         3. Tenue vestimentaire imposée. Lors du dîner de Gala, il existe un code vestimentaire obligatoire nommé Black-Tie. Ce code peut se définir comme une tenue de soirée (moins formelle que white tie) composée d’une veste de smoking, d’un pantalon assorti, d’une chemise blanche et d’un nœud papillon noir, ou d’un costume national ou militaire. Si celui-ci n’est pas respecté, l’entrée ne sera pas autorisée.
         4. Personnes Accompagnatrices. Les Personnes Accompagnatrices ne peuvent pas être présentes lors des conférences de formation, ni les réceptions organisées dans le cadre de l’Evènement, ni aux diners de Gala.
   7. Plan de la localisation géographique de l’Evènement. L’Evènement se tient sur une zone géographique qui sera scindée en deux zones respectivement nommée « Zone Business » et « Zone Premium ». Le plan des zones peut être modifié à tout moment par l’Organisateur.
   8. Absence de transmission aux Participants d’un enregistrement filmographique de l’Evènement. L’Organisateur peut enregistrer les formations qui seront dispensées à des fins d’archivage mais ces enregistrements ne seront pas, par principe, transmis au Participant. Il appartient donc au Participant de prendre toutes les notes utiles lors des explications orales fournies par les intervenants de l’Evènement si un support physique ou numérique n’est pas transmis par l’intervenant. Il est formellement interdit pour le Participant d’enregistrer les formations dispensées dans le cadre de l’Evènement.
7. ARTICLE 7 : RESPONSABILITÉ
   1. L’Organisateur n’est pas responsable :
      1. des éventuelles attentes subjectives insatisfaites du Participant liées à l’organisation et au déroulement de l’Evènement et qui n’auraient pas été expressément prévues dans ces conditions générales;
      2. de la vie, de la santé et des effets personnels du Participant pendant l’Evénement, ni des accidents ou des vols de biens commis à l’encontre du Participant ou de tiers;
      3. des dépenses personnelles du Participant liées au transport, à la restauration, aux réservations d’hôtel, aux billets, à l’hébergement dans la ville où se déroule l’événement, à l’assurance maladie et aux autres dépenses du Participant ni en cours de l’Evénement ni en cas de modification ou de l’annulation pour cause de force majeure;
      4. du comportement, des déclarations, de l’opinion personnelle d’aucun des Participants à l’Evénement;
      5. tout dysfonctionnement technique du réseau ou des serveurs ou tout autre évènement échappant au contrôle raisonnable et qui aurait comme conséquence l’annulation ou la modification d’une partie de programme;
      6. des décisions des organes compétents concernant l’inclusion ou non des heures de formation en tant que des « heures de formation professionnelle »;
      7. des informations que le Participant fournit personnellement ;
      8. des actions, omissions, du fait de tous tiers qui seraient concernées directement ou indirectement ou à quelque titre que ce soit dans l’organisation de l’Evènement et qui entraîneraient des dysfonctionnements dans le travail, le déroulement, le changement du programme et de manière générale une quelconque modification dans l’organisation, le déroulement ou autres par rapport à la description du programme et/ou le déroulement de l’Evénement;
      9. de la collaboration future avec les spécialistes intervenants ou pour les enseignements dispensés par eux lors de l’Evènement ;
      10. du plan/structure de l’intervention, des sources d’information ainsi que des supports éventuels (distribution, forme, volume ou autre) déterminés par les Intervenants;
      11. pour les images, photos et/ou vidéo faites par les Participants à l’Evénement et leur usage ultérieur et/ou le résumé/citation de l’enseignement dispensé lors de l’Evénement sur les réseaux sociaux ou une autre plateforme ;
      12. de la qualité de l’image du Participant sur les photos et vidéos réalisées pendant l’Evénement, et/ou qui seront transmises aux Participants après l’Evènement;
      13. En tout état de cause, la responsabilité de l’Organisateur est plafonnée à l’égard du Participant, professionnel, au montant du prix payé hors taxes par lui en contrepartie de la fourniture du service dans le cadre duquel s’inscrit le litige. Ce montant s’entend comme le maximum que pourrait être amené à régler l’Organisateur à titre d’indemnité (dommage et intérêts) et de pénalité, quels que soient les chefs de préjudices allègues et les fondements juridiques retenus.
8. ARTICLE 8 : CONDITIONS DE L’ANNULATION ET/OU LE CHANGEMENT DES DATES
   1. Indépendamment de la nature ou de la gravité de la cause d’annulation de l’inscription, les modalités d’annulation sont identiques.
   2. Cas de force majeure. En cas de force majeure, l’Organisateur a le droit d’apporter des modifications nécessaires au programme, de reporter l’Evénement à de nouvelles dates ou annuler le programme.
   3. La modification partielle ou totale des modalités de l’Evénement (changement de lieu, de date) n’ouvre droit à aucune indemnité pour le Participant.
   4. Indépendamment des circonstances qui pourraient causer l’annulation totale ou partielle d’une intervention annoncée, l’Organisateur se réserve le droit d’organiser ou non cette intervention ultérieurement ou de l’organiser sous un format en ligne ou sans fournir de compte-rendu.
   5. En cas d’annulation de l’Evènement du fait de l’Organisateur. Si l’Organisateur annule l’Evènement, il rembourse alors au Participant la totalité du montant du prix payé indépendamment de la catégorie dans un délai de 180 jours suivant la réception du formulaire de Remboursement rempli par le Participant.
   6. En cas de modification de l’Evènement du fait de l’Organisateur.
      1. Si l’Organisateur apporte des modifications dans les dates du programme, le délai entre l’annonce du report par l’Organisateur et l’annonce des nouvelles dates du programme peut aller jusqu’à 2 ans, en fonction de la gravité de la situation constituant le cas de force majeure qui a nécessité le report ;
      2. Seulement après l’annonce de nouvelles dates, si elles ne conviennent pas au Participant, celui-ci a la possibilité de demander le remboursement qui sera effectué dans un délai de 180 jours suivant la réception du formulaire de Remboursement rempli par le Participant.
      3. En cas de remboursement il sera effectué sur la carte bancaire du Participant, si le paiement a été effectué par carte bancaire (si le délai de remboursement par carte bancaire n’est pas dépassé) ou par virement sur le compte courant en euros, selon les coordonnées indiquées par le Participant dans le formulaire rempli.
      4. Le montant du remboursement peut être unilatéralement réduit par l’Organisateur du montant équivalent à la commission bancaire due au transfert international.
   7. L’Organisateur n’est pas responsable du risque financier engendré par le Participant en cas de modification des dates du programme ou de l’annulation du programme.
   8. Dans le cas où le Participant ne peut plus assister à l’Evènement quelle que soit la raison:
      1. Tarif STANDARD : Si le Participant ne peut plus assister à l’Evènement pour lequel il s’est inscrit, et dans le cas où aucune modification des modalités d’organisation de l’Evènement n’a été imposé par l’Organisateur, le tarif STANDARD n’est pas remboursable et n’est pas échangeable.
      2. Tarif BUSINESS & PREMIUM : Dans le cas où le Participant ne pourrait plus participer à l’Evènement alors même qu’aucune modification des modalités d’organisation de l’Evènement n’a été imposé par l’Organisateur, ces tarifs donnent la possibilité de procéder au remboursement sans pénalités si l’annulation a été faite avant la date indiquée dans le tableau récapitulatif des prestations par catégories et de leurs frais d’enregistrement respectifs. Après cette date, et avant la tenue de l’évènement, le prix de réservation versé par le Participant ne sera plus remboursable. Cette précision est indiquée expressément dans le tableau récapitulatif et le Participant déclare y consentir expressément.
9. ARTICLE 9 : DROIT A L’IMAGE
   Droit à l’image. Lors de l’Evènement, le Participant autorise expressément l’Organisateur à prendre des photographies ou des films du Participant et à réutiliser ces images à des fins publicitaires ou commerciales. Le Participant renonce à toute rémunération au titre de l’exploitation par l’Organisateur de ces supports à des fins publicitaires ou commerciales.
10. ARTICLE 10 : PROPRIETE INTELLECTUELLE
    1. L’Organisateur est titulaire de tous les droits de propriété intellectuelle relatifs au Site et à la Plateforme, contenus, textes, images, graphismes, logo, icônes, sons, logiciels constituant les outils et les supports de formations des Evènements, et de la Plateforme qui lui appartienne ou détient les droits d’usage y afférents hors les supports créés par un Intervenant, ce dernier conservant tous les droits de propriété intellectuelle sur ses créations.
    2. L’accès au Site et/ou à la Plateforme ne confère aucun droit à l’Utilisateur sur les droits de propriété intellectuelle relatifs aux Sites et à la Plateforme, qui restent la propriété exclusive de l’Organisateur ou des tiers formateurs.
    3. L’Utilisateur ne peut, en aucun cas, reproduire, représenter, modifier, transmettre, publier, adapter, sur quelque support que ce soit, par quelque moyen que ce soit, ou exploiter de quelque manière que ce soit, tout ou partie des Sites ou Plateforme sans l’autorisation écrite préalable de l’Organisateur ou des tiers formateurs. L’exploitation non préalablement autorisée par l’Organisateur ou les tiers, à quelque titre que ce soit, de tout ou partie des Sites et Plateforme pourra faire l’objet de toute action appropriée, notamment d’une action en contrefaçon.
    4. En contrepartie du paiement du prix demandé lors de la commande, les contenus, techniques, savoir-faire, méthodes fournies et transmis et plus généralement toutes informations et accès à la Plateforme ou à tout type de contenu pouvant faire partie du Service fourni font l’objet d’un droit d’utilisation personnel, non cessible et non exclusif pour la durée du Service. A ce titre, le Participant s’interdit d’utiliser et d’exploiter le Service pour le compte d’autres personnes. Le Participant engage sa responsabilité en cas de cession ou de communication des contenus ou de ses codes d’accès non autorisée.
    5. Le Participant se porte fort du respect des droits de propriété intellectuelle de l’Organisateur ou les Intervenants par l’ensemble de ses préposés susceptibles d’avoir des accès autorisés aux contenus du Site, Service et/ou à la Plateforme ou d’être Utilisateur.
    6. Tous les signes distinctifs par l’Organisateur sont protégés par la loi et toute utilisation non autorisée par la Société pourra donner lieu à des poursuites.
    7. Le non-respect de cette clause sera analysé comme une faute grave du Participant portant préjudice à l’Organisateur qui se réserve la possibilité, dans ce cas, de résilier le contrat aux tords du Participant.
11. ARTICLE 11 : PROTECTION DES DONNEES PERSONNELLES
    1. L’Organisateur respecte la vie privée des Participants et s’engage à ce que la collecte et le traitement automatisé de leurs données qui ont pour finalité la prospection commerciale, la gestion des commandes et la délivrance du Service, effectués à partir des Sites et à d’éventuelles plateformes soient conformes au Règlement général de la protection des données n°2016-679 du 27 avril 2016 dit « RGPD » à la Directive ePrivacy, ainsi qu’à la loi n° 78-17 du 6 janvier 1978 modifiée dite « Informatique et Libertés».
    2. Pour plus d’information sur les traitements automatisés de données et les modalités d’exercice de ses droits, tout Utilisateur peut consulter la politique de confidentialité accessible à tout moment sur le Site via le lien URL XXX et les mentions d’information sur les cookies utilisés par la Société pour plus d’informations.
    3. Le Participant est informé et accepte que le Service puisse comporter des dispositifs techniques permettant de suivre l’utilisation du Service (compte de l’utilisateur connecté, adresse IP, type d’application utilisées, logs divers de connexion et d’utilisation, données de visualisation et téléchargement) sont susceptibles d’être utilisées dans le cadre de la lutte anti-contrefaçon, et/ou pour identifier et/ou prévenir une éventuelle exécution illicite ou non-conforme du Service.
    4. Le Participant possède par ailleurs le droit d’introduire une réclamation auprès de la Commission Nationale de l’Informatique et des Libertés (CNIL), notamment sur son site internet www.cnil.fr.
12. ARTICLE 12 : NULLITE OU MODIFICATION D’UNE OU PLUSIEURS CLAUSES DU CONTRAT
    Si l’une quelconque des dispositions du présent contrat était annulée, cette nullité n’entrainera pas la nullité des autres dispositions du contrat qui demeureront en vigueur entre les parties. Tout amendement, résiliation ou abandon de l’une quelconque des clauses du présent contrat ne sera valable qu’après accord écrit et signé entre les parties.
13. ARTICLE 13 : SITES PARTENAIRES – LIENS HYPERTEXTES
    L’Utilisateur peut accéder, par les liens hypertextes présents sur le Site ou la Plateforme, aux sites de Partenaires ou de tiers, qui ne sont pas régis par les présentes Conditions Générales. L’Utilisateur est, en conséquence, invité à examiner les conditions générales d’utilisation ou de ventes, ainsi que les politiques de confidentialité ou toutes autres informations légales, applicables sur ces sites. Le Participant est informé que le Service peut nécessiter l’accès à d’autres sites ou plateformes, conçus et gérés sous la responsabilité de tiers. Aucun contrôle sur les contenus desdits sites n’est exercé de la part de la Société qui décline toute responsabilité s’agissant de leur contenu et de l’utilisation faite par tout tiers des informations y figurant. Cette clause s’applique à tout contenu des Partenaires.
14. ARTICLE 14 : LITIGES/DIFFÉRENDS
    1. Droit applicable. Les présentes CGV sont régies par le droit français sous réserve des dispositions pouvant s’appliquer selon la nationalité ou le domicile du Participant.
    2. Langues. Les présentes CGV sont rédigées en langue française et anglaise. En cas de litiges, le texte français prévaudra.
    3. En cas de violation du présent contrat par le Participant, l’Organisateur est en droit:
       1. D’Émettre un avertissement à l’égard du Participant;
       2. De suspendre toute participation ultérieure du Participant à l’événement ;
       3. D’interdire au Participant tout participation aux futurs événements de l’Organisateur ;
       4. De contacter les autorités compétentes tant dans le pays de l’Evénement que dans le pays de nationalité/résidence du Participant;
       5. De s’adresser au tribunal du lieu du siège de l’Organisateur.
    4. Résolution amiable du litige entre les parties. La voie amiable devra être privilégiée pour tout différend entre les parties concernant la portée, l’existence, la validité, l’interprétation et l’application des présentes CGV. Pour ce faire, le Participant devra adresser ses réclamations à l’Organisateur par courrier postal avec AR.  ‘Organisateur est tenu d’examiner les réclamations reçues et de fournir une réponse dans un délai de 30 jours ouvrables après la date de la réception.
    5. Si une résolution amiable du litige entre les parties n’était pas possible, les avocats de l’Organisateur se substitueront automatiquement à celui-ci afin d’assurer toute correspondance et communication en français avec le Participant au siège de l’Organisateur.
    6. Tous les frais juridiques et judiciaires relatifs au règlement amiable (négociations par avocats) ou judiciaire (action en justice engagée par l’Organisateur ou par le Participant) seront supportés exclusivement par le Participant.
    7. En cas de règlement judiciaire du litige, les juridictions de la ville du siège social de l’Organisateur seront exclusivement compétentes.
